Draft for legal review — not final wording
Terms of service
Last updated
These terms govern a business's use of Moving Loyalty, a product of Devya (https://devya.dev). Cardholders' use of a card is governed by the programme terms each business sets.
The service
Moving Loyalty lets a business create loyalty programmes, issue cards to Apple Wallet, Google Wallet and the web, award and redeem from a counter screen or the staff app, and send offers to consenting cardholders within the notification limits the platform enforces.
Apple Wallet cards are signed with the business's own Apple Pass Type ID; the business keeps its Apple Developer Program membership current. Google Wallet cards are issued under the platform's issuer account unless the business connects its own.
Plans and payment
Plans, included limits and prices are listed on the pricing page in EGP or SAR and exclude VAT. Annual plans equal ten monthly payments. After a missed payment there is a 7-day grace period; afterwards the dashboard becomes read-only and offers pause. Cardholders' cards keep working and keep updating.
The business's duties
Describe rewards honestly and honour them. Keep the marketing permit (Egypt) or discount licence (Saudi Arabia) references the dashboard asks for before sending the offers that need them. Health businesses keep neutral card wording and obtain the regulator approval the platform asks for before sending offers.
Keep staff accounts personal; staff can undo their own award for ten minutes, managers can reverse with a reason, and every change is logged.
Points and stamps have no cash value, cannot be bought or transferred, and may be adjusted to correct errors.
Data
The business is the controller of its cardholders' data and Devya processes it on its behalf under the privacy policy and a data-processing agreement; each country's stack stays in that country.
Liability and changes
Service is provided as described, with reasonable care; liability is limited to the fees paid in the previous twelve months. We may change these terms with 30 days' notice. Draft for counsel — not yet reviewed.
